Union Bank Of India – Lilavati Hospital Controversy

DATE: 9th April 2011

Union Bank of India, the Bankers of Lilavati Hospital through their lawyers NN Amin & Co., issue notices to M/s Vidhi Partners and M/s Thakore Jariwala & Associates, the lawyers of 2 warring factions of Lilavati Kirtilal Mehta Medical Trust threatening them to freeze the Hospital accounts.

However, UBI neither send such notice nor inform about freezing the Hospital accounts to Niket Vijay Mehta, Managing & Permanent Trustee, Lilavati Kirtilal Mehta Medical Trust, belonging to the THIRD CAMP trying to preserve the legacy of Lilavati Hospital.

Mr. Niket Vijay Mehta hears for the first time about any such notice from the media as the notice wasn’t sent to him.

Media starts chasing Mr. Niket Vijay Mehta, Managing & Permanent Trustee, Lilavati Kirtilal Mehta Medical Trust on the issue of account freeze notice by Union Bank Of India.

Niket Vijay Mehta makes strong objection to this arbitrary and unlawful notice of freezing the accounts of Hospital. His lawyer, Dinesh Tiwari says that the accounts cannot be frozen like this and the bank (UBI) should approach a court of law.

Mid Day publishes the story with a headline saying, “TREATMENTS TO STOP AT LILAVATI FROM MONDAY?”

Such news creates a panic situation among patients and a flurry of Media Calls start coming to Mr. Niket Vijay Mehta, Managing & Permanent Trustee, Lilavati Kirtilal Mehta Medical Trust.

Before the situation could get worse, Niket Mehta, through his lawyer Dinesh Tiwari, serves a legal notice to Union Bank Of India asking them that such an act of freezing the accounts can endanger the lives of patients and all claims liabilities generated from the patient’ side including from the Insurance companies due to sabotaging Hospital operations will be automatically transferred to Union Bank Of India.

Media reports this and publishes an attempt of Niket Vijay Mehta to ensure smooth functioning of the Hospital and prevent the bankers i.e. Union Bank Of India to freeze the accounts unlawfully.

DATE – 18th April 2011

Union Bank Of India bows down and through their lawyers, NN Amin & Co. issue a Clarification and decides NOT TO FREEZE the accounts of the Hospital.

Such a Notice is sent out to the media and both the two warring factions of the trust fighting for a control BUT the Bank once again chooses to ignore informing Mr. Niket Vijay Mehta, Managing & Permanent Trustee, Lilavati Kirtilal Mehta Medical Trust.

Certain media reports the news along with inputs from Union Bank of India Clarification but still panic among people does not subside.

DATE – 22nd April 2011

While Union Bank had issued a clarification already on 18th, the warring Camps continue to feed the media with rumours and stories of accounts being frozen thereby creating increasing panic situation.

Especially TV Channels continue to show this news even after the issue has been closed.

Media once again start chasing Mr. Niket Vijay Mehta, Managing & Permanent Trustee, Lilavati Kirtilal Mehta Medical Trust for clarifications.

In order to stop further rumours and save the patients from panic, Mr. Niket Vijay Mehta, Managing & Permanent Trustee, Lilavati Kirtilal Mehta Medical Trust sends out a strong notice through his lawyer to Union Bank Of India and questions the Bankers’ intentions and alignments with any of the 2 warring factions, which have been using media to hit at each other and in the process completely maligning the image of institution at the same time.

Union Bank Of India responds through their lawyers to the legal notice and accepts that the notice of freezing of accounts was triggered only due to a letter sent by one of the trustees from the warring factions.

In a strong communication through his lawyers, Mr. Niket Vijay Mehta, Managing & Permanent Trustee, Lilavati Kirtilal Mehta Medical Trust tells the Union Bank Of India that institutions such as theirs have to be led by good governance and should not be misused by litigant factions to trigger rumours and panic among patients.

Hospital is functioning normally till date. Was it justified to be a party in creating unnecessary rumours and thereby panic among patients for one of the warring factions or the Union Bank of India?
